FAIRMONT -- An FBI police officer has pleaded guilty to conspiracy.
Gary Sutton Jr., of New Milton, will spend six months on probation for his part in invading the privacy of young girls taking part in the Cinderella Project, a discount prom gown event sponsored by Marion County Hospice.
Sutton and another officer, Charles Hommema, of Buckhannon, were working in the FBI Satellite Control Center at the Middletown Mall on April 4, 2009, according to court documents.
Between 9:34 a. m. and 11 a. m. they pointed the FBI security cameras used in the mall at one of five makeshift dressing rooms set up for the event, the documents say, and caught one of the young women topless.
Marion County deputies arrested the pair in April.
Special Magistrate Joey Kohari dropped Sutton's other charge, invasion of privacy, as part of the agreement.
Homemma's trial is scheduled for December.
"Unfortunately in accordance with Dept. of Justice guidelines I cannot comment as this remains an ongoing legal matter," says Steve Fischer of the FBI's Criminal Justice Information Services Division.
