CHARLESTON -- One year later -- and still going strong -- allowing smokers to light up inside the Blackhawk Saloon.

Wednesday, the Blackhawk Saloon held it's second annual smoker's night inside the bar.

The establishment has been allowing smoking inside since the county wide clean indoor air regualtion went into effect last year.

Owner Kerry Ellison says taking away smoking means taking away his business.

"I'm in the beer selling business," he said. "If you come in and you want to smoke a cigarette while you drink your beer and I tell you you can't smoke your cigarette and you go elsewhere and buy your beer, now that effects me."

Health officials did stop out to the bar *several* times throughout the night, and slapped Ellison with more citations.

He still has another pending in court.

While he gets citations - it is all okay to go into the cigarette/cigar shop on cross lanes drive (kanawha county) to buy cigarettes and be gagged by the smell of cigar smoke while standing at the cash register. I think the KCHD is full of themselves. And, if they legislators of this state do not do something to these rules, they all should be voted OUT of office. While I am a non-smoker something has to give. If you can buy them, pay taxes on them, then light them up. If you don't like the smell, then go elsewhere. Post you smoke, and let adults make informed decisions to enter or not. That simple. Go Kerry Ellison!

This is ridiculous. The rule is ridiculous. Everyone knows this is a smoker bar. Like everything else in the world, if you dont like it, or you dont smoke, dont go there. Smoking may not be healthy, but it is legal. If this establishment is for smokers to go, then leave them alone, and non smokers go elsewhere. This is just like not being a drinker, if you dont drink, dont go to a bar. That happens everyday, and if anyone recalls they tried to make that completely illegal once to, a little thing called prohibition, you see how that worked out. The county IS simply harrassing the guy, if you came and gave him a citation once, let it go, you dont need to keep coming back to do the same thing over and over again. Just take it to court.
